Apache 1.3.26 + tomcat 3.3.1

While i try to start tomcat i get the following error
in /var/log/messages:

The exact command invoking Tomcat is as follows:

/usr/lib/j2re1.4.0_01/bin/java -Djava.security.policy==/etc/tomcat3/conf/tomcat.policy

kernel 2.4.18
grsec 1.9.4

How to solve that and allow tomcat to run ?

Use 1.9.7. Lots of changes have been made since 1.9.4.
